Acceptable Use & Prohibited Activities Policy
Restricted services, illegal activity, spam, malware, and platform misuse.

This Acceptable Use & Prohibited Activities Policy (the “Policy”) forms part of the contractual framework governing the use of the OXLY platform (the “Platform”) operated by IN SPOT SLU, a company organized under the laws of the Principality of Andorra, with registered office at Carretera d’Engolasters 27A 2-1, Andorra, tax / registration number L-919089-T (“OXLY,” “Company,” “we,” “us,” or “our”).
This Policy applies to all users of the Platform, including without limitation:
- visitors;
- Customers;
- Providers;
- Employees;
- Admin users;
- any person or entity using the Platform’s profiles, listings, service cards, booking tools, messaging tools, payment flows, APIs, support channels, content tools, or related services.
This Policy supplements the Terms of Platform Use, the Provider Terms, the Payments & Payout Terms, the Booking, Cancellation & Refund Policy, the Fees & Pricing Transparency Policy, the Content, Images & Intellectual Property Policy, the Community Standards, and any other applicable OXLY policies. If there is a conflict between this Policy and a more specific rule that clearly applies to a particular feature or category, the more specific rule will control for that matter to the extent permitted by law.
By accessing or using the Platform, you agree to comply with this Policy.
1. Purpose of This Policy
The purpose of this Policy is to define:
- permitted and prohibited uses of the Platform;
- prohibited services, categories, and activities;
- rules against unlawful, dangerous, deceptive, or abusive conduct;
- restrictions on spam, spoofing, malware, scraping, circumvention, and misuse of Platform systems;
- the Company’s rights to investigate, restrict, suspend, terminate, delist, remove, disable, freeze, reserve, offset, or otherwise act in response to violations.
OXLY is intended to be used only for lawful, trustworthy, and policy-compliant purposes.
2. Core Acceptable Use Rule
You may use the Platform only:
- for lawful purposes;
- in good faith;
- in compliance with these Terms and all applicable Platform policies;
- in a way that does not harm users, the Platform, payment systems, app stores, service providers, regulators, or third parties;
- in a way that does not create unreasonable legal, financial, operational, safety, or reputational risk.
Any use of the Platform that falls outside this standard may be restricted or prohibited by the Company.
3. Prohibited Services and Categories
You must not use the Platform to offer, advertise, publish, request, facilitate, promote, arrange, or perform any prohibited service or category.
Unless the Company expressly permits a specific category in writing and all legal requirements are met, prohibited services include, without limitation:
3.1 Sexual and Exploitative Services
- escort services;
- prostitution-related services;
- sexual services of any kind;
- sexually exploitative services;
- adult services involving in-person sexual activity;
- services involving coercion, exploitation, trafficking, or abuse.
3.2 Medical, Health, and Regulated Care Services Without Required Authorization
- medical diagnosis, treatment, consultation, or prescription-related services without any verification, licensing, or compliance steps required by law or by the Company;
- sale, distribution, recommendation, or facilitation of prescription drugs or controlled substances without lawful authorization;
- services requiring professional medical oversight where such oversight is absent or misrepresented.
3.3 Weapons, Explosives, and Dangerous Goods
- firearms;
- ammunition;
- explosives;
- explosive materials;
- bomb-making or weapon-modification services;
- prohibited dangerous goods;
- services involving unlawful procurement, sale, or handling of weapons or explosive materials.
3.4 Gambling, Betting, and Fraudulent Financial Schemes
- casinos;
- betting services;
- unlawful gaming;
- lottery or sweepstakes services requiring authorization where such authorization is absent;
- pyramid schemes;
- Ponzi schemes;
- deceptive investment solicitations;
- fraudulent financial opportunities.
3.5 Illegal or Unauthorized Regulated Services
- services that are illegal in the applicable jurisdiction;
- services requiring a permit, license, registration, certification, or other regulatory authorization that the Provider does not hold or does not maintain;
- services prohibited by law, app-store rules, payment-provider rules, or Platform policy.
3.6 High-Risk or Dangerous Activities
- activities that create unreasonable risk of physical injury, public danger, or unlawful harm;
- services involving unlawful hazardous materials;
- services involving criminal conduct or violent activity;
- dangerous or extreme activities prohibited by law or by Company policy.
3.7 Other Restricted or Prohibited Categories
The Company may designate additional categories as prohibited, restricted, sensitive, or high-risk at any time.
The fact that a category, tag, keyword, or form field appears on the Platform does not mean that the Company approves, verifies, or guarantees the legality of any service offered under that label.
4. Illegal Activity Is Prohibited
You must not use the Platform for any unlawful purpose or in connection with any unlawful act.
This includes, without limitation:
- fraud;
- money laundering;
- terrorist financing;
- sanctions evasion;
- trafficking;
- forgery;
- identity theft;
- illegal surveillance;
- theft;
- sale or facilitation of unlawful goods or services;
- tax evasion through deceptive use of Platform tools;
- unlawful solicitation, distribution, or procurement of controlled substances;
- unlawful commercial, professional, or regulated activity.
Users are solely responsible for identifying, understanding, and complying with the laws that apply to their services, content, conduct, and transactions.
5. Dangerous, Unsafe, and Harmful Activities
You must not use the Platform to create, enable, or promote unsafe conditions or harmful conduct.
Prohibited activity includes, without limitation:
- threatening physical harm;
- coercing another user into an unsafe meeting, unsafe location, or unsafe transaction;
- facilitating dangerous conduct prohibited by law or Platform policy;
- offering services that create unreasonable danger to minors, vulnerable persons, homes, workplaces, or public spaces;
- encouraging self-harm, violence, or criminal conduct;
- using the Platform for activities involving unlawful hazardous tools, substances, or settings.
Where a category involves elevated safety concerns, the Company may impose enhanced verification, insurance, disclosure, moderation, or operational restrictions.
6. Fraud, Misrepresentation, and Deception
You must not deceive users, payment systems, regulators, or the Platform.
Prohibited conduct includes, without limitation:
- impersonating another person, business, or authority;
- spoofing a business identity, profile, verification status, or licensing status;
- misrepresenting qualifications, permits, insurance, or business registration;
- fake listings;
- fake bookings;
- fake customer identities;
- false or misleading service descriptions;
- bait-and-switch pricing or service presentation;
- fake reviews or reputation manipulation;
- forged documents;
- falsified screenshots, evidence, invoices, or dispute materials.
Any fraudulent or deceptive activity may result in immediate suspension or termination.
7. Off-Platform Abuse and Circumvention
Where the Platform requires certain flows to happen through the Platform, users must not bypass those flows in a way that undermines trust, safety, moderation, pricing integrity, or payment protection.
Without limiting other rules, prohibited conduct includes:
- soliciting direct contact details before a Booking where Platform rules prohibit that conduct;
- encouraging users to move a transaction off-platform in order to avoid mandatory Platform controls;
- rerouting a lead or booking outside the Platform to avoid fees, payment checks, moderation, documentation, or trust systems;
- asking a user to pay by cash, transfer, wallet, invoice, or another off-platform route where in-platform payment is required;
- using private messages to circumvent booking, fee, refund, or complaint systems;
- recreating the same transaction off-platform to defeat required Company Fee structures or payment-protection rules.
This clause does not prohibit every off-platform interaction in every circumstance. It prohibits off-platform abuse, fee avoidance, and circumvention of mandatory Platform controls.
8. Hidden Charges and Payment Evasion
Users must not use the Platform to conceal, reframe, or evade required pricing or payment rules.
Prohibited conduct includes, without limitation:
- demanding undisclosed mandatory charges after a Booking is initiated or confirmed;
- splitting mandatory charges into misleading components to make the headline price look artificially low;
- requesting side payments outside approved flows;
- disguising the nature of a payment to avoid processor restrictions;
- processing a prohibited service through a misleading payment description;
- moving a transaction off-platform to avoid Company Fees, reserves, holds, tax disclosures, or chargeback protections.
The Company may treat payment circumvention as a serious violation.
9. Spam, Phishing, and Unwanted Communications
You must not use the Platform to send, facilitate, or support spam, phishing, or abusive communications.
Prohibited conduct includes:
- bulk unsolicited messages;
- repetitive commercial solicitation;
- chain messages;
- deceptive links;
- credential-harvesting attempts;
- impersonation emails or messages;
- malware delivery through messages or attachments;
- abusive promotional messages unrelated to the purpose of the Platform.
The Company may filter, block, remove, or restrict such communications without notice where reasonably necessary.
10. Malware, Security Abuse, and Technical Attacks
You must not use the Platform to interfere with, damage, probe, or abuse the Platform or related systems.
Prohibited conduct includes, without limitation:
- uploading malware, ransomware, spyware, worms, or other malicious code;
- introducing harmful scripts or payloads;
- attempting unauthorized access to accounts, databases, or infrastructure;
- penetration testing without prior written authorization;
- vulnerability exploitation;
- denial-of-service attacks;
- credential stuffing;
- brute-force login attempts;
- session hijacking;
- circumvention of authentication or access-control mechanisms.
The Company may preserve logs, evidence, and metadata and may cooperate with competent authorities or technical partners in response to such conduct.
11. Spoofing, Impersonation, and Identity Abuse
You must not impersonate, spoof, or falsely represent:
- another user;
- another business;
- a regulator, court, authority, or payment provider;
- a Platform employee or official representative;
- the existence of a partnership, certification, endorsement, or badge that does not exist.
This includes, without limitation:
- fake profiles;
- fake support accounts;
- fake provider identities;
- fake customer identities;
- use of misleading logos, trademarks, names, or branding;
- deceptive domain names, usernames, or contact details.
12. Scraping, Data Extraction, and Unauthorized Automation
Unless expressly authorized by the Company in writing, you must not:
- scrape, crawl, harvest, or extract Platform data at scale;
- use bots or automated scripts to access the Platform in an unauthorized way;
- collect personal data from the Platform for unrelated commercial use;
- copy listings, service cards, prices, reviews, or other structured data in a way that harms users or the Platform;
- circumvent rate limits, anti-bot protections, or technical restrictions.
Normal search-engine indexing or other access expressly permitted by the Company is not prohibited by this section.
13. Abuse of Reviews, Complaints, and Platform Processes
You must not weaponize Platform systems.
Prohibited conduct includes, without limitation:
- fake or coordinated complaints;
- abusive refund requests;
- false no-show claims;
- chargeback abuse;
- fabricated evidence;
- bad-faith IP complaints;
- abusive trust and safety reports;
- using reviews, complaints, or payment disputes as leverage for extortion or retaliation.
The Company may treat misuse of Platform processes as a serious policy violation.
14. Prohibited Content-Linked Activities
You must not use the Platform to upload or distribute content that is unlawful, deceptive, infringing, abusive, or unsafe.
Without limiting the separate Content, Images & Intellectual Property Policy, prohibited content-linked activities include:
- publishing content that facilitates prohibited services;
- uploading misleading visuals intended to conceal unlawful or dangerous conduct;
- posting forged licenses, certificates, insurance documents, or identity records;
- posting instructions or promotional materials for illegal acts;
- publishing content intended to bypass legal or Platform restrictions.
15. Abuse Affecting Minors or Vulnerable Persons
You must not use the Platform in connection with:
- exploitation or grooming of minors;
- abusive services involving vulnerable persons;
- unlawful childcare, eldercare, or care-related services;
- conduct that places minors or vulnerable persons at unreasonable risk;
- services involving sensitive populations without any legally required authorization, safeguarding, or compliance.
The Company may impose higher moderation thresholds and immediate enforcement in such cases.
16. High-Risk and Restricted Categories
Certain services may be classified by the Company as:
- restricted;
- high-risk;
- verification-gated;
- country-limited;
- payment-limited;
- invitation-only;
- prohibited.
The Company may apply enhanced rules, including:
- category-specific onboarding;
- document requirements;
- licensing review;
- insurance review;
- payout restrictions;
- extra moderation;
- limited discoverability;
- complete prohibition.
The Company may change category treatment at any time.
17. Reporting Violations
Users may report suspected violations of this Policy through Platform tools where available or via:
- help@oxly.eu
- a.samoylov@inspot.ad
A report should include, where reasonably possible:
- the relevant profile, listing, service card, message, or Booking identifier;
- a description of the conduct;
- relevant screenshots, links, or supporting materials;
- dates and context.
The Company may request additional information.
18. Investigation and Cooperation
The Company may investigate suspected violations of this Policy.
As part of an investigation, the Company may:
- review listings, profiles, messages, bookings, payment data, and related records;
- request clarifications, documents, or explanations;
- review category, payment, and verification status;
- preserve evidence and logs;
- consult service providers, advisers, payment partners, or trust and safety partners where appropriate;
- cooperate with competent authorities where legally required or reasonably necessary.
Users are expected to cooperate in good faith with legitimate investigations. Failure to cooperate may affect the outcome of a review.
19. Enforcement Rights
Where the Company reasonably believes that a user has violated this Policy, the Company may take one or more enforcement actions.
These may include, without limitation:
- issuing a warning;
- requesting clarification, correction, or undertakings;
- removing or hiding content;
- disabling a service card, listing, profile element, or campaign;
- restricting messaging;
- restricting booking or payment functionality;
- removing badges or trust signals;
- placing limits on category access;
- freezing, delaying, reserving, offsetting, or withholding payouts where permitted by law and the applicable payment terms;
- suspending or terminating an account or role;
- blocking access to the Platform;
- issuing refunds or taking payment-protective action where permitted by law and the relevant policy framework.
20. Immediate Action for Serious Violations
Although the Company will generally seek to issue a warning where reasonably practicable, the Company may act immediately, with or without prior notice, where it reasonably considers immediate action necessary due to:
- prohibited services;
- illegal activity;
- serious fraud;
- payment circumvention;
- malware or technical attacks;
- credible safety threats;
- severe harassment or abuse;
- exploitation of minors or vulnerable persons;
- serious regulatory or payment-provider risk;
- urgent operational or legal risk.
Immediate action may include:
- immediate takedown of content;
- immediate delisting of a service card or listing;
- immediate suspension or termination of a Provider or other user;
- immediate freezing, delaying, or reserving of payouts;
- immediate disabling of payment-related functionality.
21. No Obligation to Allow or Continue Access
Access to the Platform is conditional and revocable.
The Company is not required to allow, continue, restore, or expand access to any category, payment flow, feature, or role merely because it was previously available.
The Company may refuse or discontinue support for any user, category, or use case that it reasonably considers incompatible with the Platform’s legal, operational, trust and safety, reputational, or commercial requirements.
22. No Guarantee of Detection
OXLY may use automated and manual tools to detect prohibited services, technical abuse, payment circumvention, fraud, and policy violations.
However, the Company does not guarantee that all harmful, unlawful, or prohibited activity will be detected, prevented, or removed immediately.
Nothing in this Policy means that the Company guarantees the legality, safety, or suitability of any service or user.
23. User Responsibility and Indemnity
You remain solely responsible for your conduct, services, communications, content, transactions, and compliance obligations.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, contractors, agents, and licensors from and against any claims, proceedings, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your breach of this Policy;
- your prohibited service or activity;
- your unlawful conduct;
- your fraud, deception, spoofing, or payment circumvention;
- your malware, technical abuse, or unauthorized automation;
- your violation of law or third-party rights.
24. Appeals
If enforcement action is taken against you under this Policy, you may request review or appeal through the process made available by the Company.
Submitting an appeal does not guarantee reversal. The Company may uphold, modify, or reverse its original decision in its discretion, subject to applicable law.
25. Changes to This Policy
The Company may update this Policy from time to time.
If material changes are made, the Company may notify users by:
- posting the updated version on the Platform;
- updating the Effective Date or Last Updated date;
- email notice;
- in-app notice;
- account notice; or
- another reasonable communication method.
Continued use of the Platform after the effective date of the revised Policy constitutes acceptance of the updated version.
26. Governing Law and Jurisdiction
This Policy is governed by and shall be interpreted in accordance with the laws of the Principality of Andorra, without regard to conflict-of-law principles.
Any dispute arising out of or in connection with this Policy shall be submitted to the competent courts of Andorra, unless mandatory consumer protection law requires otherwise.
